A teenage driver was involved in a deadly crash on State Road 681 in Sarasota County resulting in a charge of Vehicular Homicide.  The case was based upon eyewitness testimony, and the skid marks and crush damage from the vehicle crash.  Immediately after being retained, Mr. Dirmann engaged a well-known accident reconstruction expert to examine the crash site, gather evidence, take photographs, and evaluate the charges.  Having a defense expert examine the scene when it was fresh, enabled Mr. Dirmann to challenge the opinions of the Florida Highway Patrol homicide investigator and the expert witness hired by the State of Florida that the client was speeding at the time of the crash.  Mr. Dirmann was able to demonstrate that the skid mark evidence and calculations, and the crush damage analysis were incorrect and unreliable.  This led to the State’s own expert agreeing with the defense expert that it was impossible to determine the client’s speed, and therefore, the charge of Vehicular Homicide was dismissed.  The client was able to go on with his life and finish college.

A young executive with a fortune five-hundred company was involved with the dredging of land adjacent to his property without a permit.  This incident, while seemingly harmless, could have resulted in a felony charge and the loss of the client’s very valuable employment.  After many months of investigation, research, and negotiations with representatives of the Florida Department of Environmental Regulation and the State Attorney’s office, the case was resolved with a misdemeanor pre-trial diversion agreement, resulting in all criminal charges being dismissed against the client.
